I received the following email from Stage House Inn. Besides the upcoming wine dinners, they have waived their corkage fees Monday thru Friday for the months of July and August.

According to Rosie, corkage fees are ILLEGAL in New Jersey.  So how can they waive an illegal fee?

no, corkage fees are legal in jersey, as long as you have a license to sell liquor. here's a thread on which i'm hoping we compile facts and discussion on the laws.

I was just asking because it wasn't made clear within the thread, tommy.

So, as a restaurant with a license, they are within their rights to charge corkage, so offering to waive the fee is a legitimate offer to benefit their customers who would prefer to bring their own wine.

('oy' in the previous post wasn't direction towards you rachel, but rather in general that we have to rehash the ABC rules when there's a thread devoted to it. we might as well delete the thread).

When we had the egullet lunch at An American Grill this topic came up. I remember that Lou said that they do have a corkage fee but I don't remember how much it is. He did say that he doesn't like to allow someone to bring in the wine when it is a wine that is on his list. I hope he weighs in on this topic.

This is probably a moot issue because, if a resto has a liquor license, 99.999% of the time they are NOT going to allow you to bring your own!!

This is certainly not true as I have read here previously of other restaurants with a license that charge a corking fee. In addition there are places like Blue Sky & I believe Mattise that own wine stores attached to their restaurants and will serve wine. ( This is a different type of license, I own a broad C license that allow me to served alcohol and wine but cannot sell package goods.)

In addition, as I have stated before that if someone wanted to bring wine to The Grill, I would certainly allow it and base the corking fee on certain circumstances.

I can confirm that I was in the certain circumstances category. :cool:

I also concur that many restaurants that sell wine allow corkage.

I personally seek out BYO's over non because I have a large wine collection. It behooves those places that sell wine, and want my business and the business of those similar to me, to make it clear that they do corkage as well. The John Foy day Sonoma Grill for example made it well known that corkage was acceptable. It was printed on his menu along with a cute formula as to what he would charge. No one would deny he had a large and deep selection.
